Toast prohibited items

Toast may, in its sole discretion, prohibit or otherwise restrict Merchant’s use of Toast Services, including but not limited to payment processing, if Merchant offers, sells, or facilitates transactions involving any products, services, or activities listed below, or as otherwise determined by Toast or its payment processing partners (“Prohibited Items”). These restrictions may apply to Merchant’s entire business or to specific transactions, depending on the requirements of Toast and its payment processing partners. This list is not exhaustive and may be updated at any time. Merchants are responsible for ensuring compliance with Applicable Law and Rules and Toast policies. This Toast Prohibited Items policy is only applicable to Toast merchants in the United States, and other restrictions may apply in other jurisdictions.
Application of Restrictions. Toast’s payment processing partners may impose different requirements regarding prohibited items and activities. In some cases, if Merchant offers any prohibited items (e.g., firearms), Merchant may be entirely ineligible to use Toast’s payment processing services for any transactions. In other cases, only transactions involving specific items will be prohibited, while other transactions (e.g., food and beverage sales) may continue to be processed. Toast will notify Merchant of the applicable restrictions based on their payment processing setup. Merchants are responsible for understanding and complying with these requirements, and Toast reserves the right to suspend or terminate Services, in whole or in part, as necessary to comply with its own policies or those of its payment processing partners.
Current list of Prohibited Items:
- Adult services: Adult entertainment products or services, all types of pornography, escort services, and dating services
- Card-not-present tobacco sales: Including e-cigarettes and “vape” supplies and accessories
- Cash advances: Cash back, cash advances, manual cash disbursement, and quasi-cash transactions
- Cryptocurrency and digital credits: virtual currency and digital credits that can be monetized or re-sold
- Donations: Donations that are not directly tied to the sale of a physical good
- Drugs and drug paraphernalia: illegal drugs,drug paraphernalia, and related items
- Gambling and games of chance: Lotteries, odds-making services, games of chance, internet gaming, daily fantasy sports, raffles, contests, sweepstakes, special incentives, sports forecasting, the offering of a prize as an inducement to purchase goods or services, and other gambling-related services or similar activities
- In-house financing and related services: Collections services, credit repair services, and payday loan services
- Marijuana, CBD, and Related Products: Marijuana and related products or by-products, including CBD and hemp, except as permitted under Toast’s Hemp & CBD Products Policy
- Kava and kratom: Kava and/or kratom, except in limited circumstances approved by Toast
- Money service businesses: check cashing, money transfers, and any business required to be registered as a money service business.
- Pawn shops
- Pharmaceuticals: prescription drugs, substances designed to mimic illegal drugs, and supplements marketed to treat or cure a disease that have not been reviewed and approved by the Food & Drug Administration (FDA)
- Weapons and firearms: Firearms, ammunition, explosives, and related accessories
- Illegal activities or items: Any product or service sold in violation of Applicable Law and Rules
